Records Acquisition
Upon receipt of the
pertinent case details from our client, we begin preparing the required
documents. We have multiple forms and can provide samples. We have
generally acceptable notices, subpoenas, affidavits, and DWQs, but we
usually provide a sample to new clients for approval the first time.
After the first event, we generally know what our clients want. As an
example, the Depositions by Written Questions includes a series of
questions to be answered by the custodian. Many attorneys have their
own ideas about specific questions, so it is easy to add or reword
questions as requested.
In some cases,
opposing counsel will waive the required waiting period after receiving
the Notice of Intention to Take Written Deposition. Once the waiting
period is waived or the time has expired, we begin preparing the
specific legal documents to obtain the records.
They are usually
sent by certified mail, return receipt requested. However, there are
some providers which require hand-service of the subpoena. Shortly
after receipt of the confirming green card, our staff begins calling the
custodian to verbally confirm receipt of the subpoena and establish
prepay requirements and proper contacts. In the East Texas area we
already know most of these contacts and they know us.
Once the records are
received, we first ensure that the documents provided are responsive to
our original request (“any and all” or limited in time and/or scope).
If this is satisfactory, then we begin the arduous process of making
sure the records are in good order and begin formally processing the
documents. Some Affidavits utilize a certain time period while other
use the total page count. Some of the Direct Questions have specific
answers which must be accurately answered by the Custodian (especially
regarding total charges, payments made to the account, off-sets or
reductions if appropriate). It is often necessary to follow up with the
custodian and make corrections to DWQs to ensure the answers match the
information provided.
